Fall on a Staircase

An office employee tripped, fell and was injured while making their way from the ground floor down the internal stairs towards the basement level.

Cadogans was asked to investigate and provide a report setting out our views on whether the condition of the staircase contributed to the accident.

The issues were considered and a site visit was carried out.

During the site visit measurements of the various stair parameters were taken. It was noticed that there was a change in slope of the stair at the locus of the pursuer’s trip.  In addition there were no handrails on either side of the stair.

It was concluded that the Pursuer tripped and fell at the abrupt change in slope in the staircase and that the Defender had failed to identify that this stair had a tripping hazard.

The case was settled out of court prior to the hearing.
