Contractual Dispute at CCGT Power Station
Contracts were in place which had IMechE/IEE Model Form MF/1 as the general conditions. The contractor having suffered delays, disruption and additional expenses because of alleged misrepresentation implied terms and general
mismanagement invoked the arbitration clauses. Senior members of Cadogans staff acted for the contractor or claimant in engineering issues.
Two of the arbitrations settled and one went on to make legal history in the Court of Appeal in relation to construction of Clause 44.4 of MF/1.
