Slip from a Fixed Vertical Steel Ladder
An engineer regularly serviced plant located on a raised platform approximately 3 meters above the ground level. Access to the raised platform was by a fixed vertical steel ladder. While ing the ladder, the engineer’s foot slipped on the second top rung of the ladder and he fell to the ground to his injury.
Cadogans was asked to prepare an independent report on behalf of the Pursuer addressing following issues.
- The suitability of the fixed vertical steel ladder as a safe means of access to the raised platform
- The duties incumbent on the Defender as an Employer under health and safety regulations

The issues were considered and a site visit was carried out.
During the site visit it was noticed that there was no safety cage around the ladder and the rungs of the ladder had no anti-slip coating. The rungs of the ladder were also worn and were relatively shiny and smooth.
It was concluded that the site owner failed under its duty to comply with Regulation 3 of the Management of Health and Safety at Work Regulations 1999, Regulations 5, 12(1) and 12(5) of the Workplace (Health, Safety and Welfare) Regulations 1992 and Regulations 6(4) and Schedule 1 of the Work at Height Regulations because he failed to maintain the ladder in an efficient state, in efficient working order and in good repair.
The case was settled out of court prior to the hearing.
